CORPORATE IMMIGRATION ISSUES
There are a number of different types of immigration issues that a business should be aware of. When a non-Canadian business is considering establishing in Canada the non-Canadian businessman can come to Canada as either a visitor or a business visitor to do preliminary research.

When the non-Canadian business wishes to establish the business in Canada the initial businessman who will be the head of Canadian operations will require a work visa. A work visa will generally be for two years. It can be renewed. Usually the maximum total amount of time is 7 years.

If the non-Canadian business head office wishes to send someone from head office to visit or assist the Canadian office for a short period of time a business visitor visa can be obtained. This is for limited types of work and generally is for no more than 2 months.

If the businessman wishes to stay in Canada permanently and application for Canadian Landed Immigrant status can be made.

After Canadian Landed Immigrant status is obtained the businessman must obtain a Permanent Resident Card (“PR Card”). In order to initially qualify and to remain qualified the person must live in Canada for three out of every four years.

After Canadian Landed Immigrant status is obtained if a businessman is flying back and forth to Canada and the non-Canadian head office the PR Card will be needed to board an airplane to return to Canada.

After a Canadian Landed Immigrant has lived in Canada for three out of four years the person can apply for citizenship. There are several advantages of citizenship. This will allow the person to qualify to apply for a NAFTA work visa to work in the USA. The person is no longer obligated to live in Canada for two out of five years to retain Canadian status. For example the Canadian Citizen can take a five year posting in California in Silicon Valley and will not lose Canadian status while away.
